I got my green card in sept 99. I started my job on Dec 14, 1999. I got my TAX filing form from IRS in Feb 2000. IRS owed me a refund. I did not file tax return for 1999 b/c my manager told me that I did not need to file a tax return b/c I had just started my job (only 17 days in 1999). But I think that was my mistake. On the N-400 Form when they ask you "Did you ever fail to file a tax return" I checked NO. That is not true, of course. So I lied on the form. Since then (5 years) I have always filed my tax returns. My interview is on 10/11. I fear that after the interview and before calling me for the Oath, in the interim they will verify my answers on the N-400 forms and will find out that I had failed to file tax 5 years ago and lied on the form. Any suggestions? Please help. Or, should I just cancel and reschedule my interview and then file the 5 years old return? Even though I know IRS owed me a refund and I did not owe any money to them but still it is a crime to lie on the form. Thanks a million!

izh114,

You are alright and nothing to worry. IRS guidelines (to be sure check it on www.irs.gov) says that one need to file for taxes only if you make over $5K per year. So in 1999, unless you made more than that you are not required to file for a tax return per IRS. So by answering NO to whether you failed to file tax returns you have not lied in my opinion. Just concentrate on your 100 questions and you should be Ok. Good Luck and pls. post your interview expereince. What is your DO and timeline?
