The fact that you entered illegally and fraudently gained employment and possibly other benefits by defrauding the system does not look good, it is grounds for deniel. And in my opinion you shouldnt be allowed any leniancy for doing this illegally. There are hundreds of people on here that enter legally, do not work and wait months even years for their EAD before they start working they have to make do with less, & pay thousands of dollars to attorneys,and still have to wait through the process. They are more deserving of GC & Govt. priviliages than someone who intentionally defrauds the system and illegally enters the country, I have no sympathy for your situation ,

However,for the sake of your children I hope you find the right answers and are guided towards the legal direction to gaining GC citizenship & LEGAL EMPLOYMENT!

Contacting a lawyer is DEFINATELY the way to go in your case. Would not even try to do it without a professional...

Working illegaly in general would be forgiven, but the fact that he entered US illegaly and worked using a different name, I think those will be VERY serious issues with FBI and USCIS. But you never know a good lawyer might know what to do...

If he overstayed his visa, it should be ok...if you're a USC. If he entered the country w/o a visa, ilegally, then he cannot adjust his status.

According to the original post He came here illegally,

he came here illegally and is working under a different name

I interpret that as he entered illegally , therefore will need an attorney, it will be hard for him to Adjust status especially given that he has proven not to be of good moral charcater (by USCIS standards) by working illegally, & using a different name to fraudulently gain employment

Somebody got to tell me why I do have to tolerate this kind of criminal behavior and give this criminal any advice on how to become a Legal Permanent Resident.

Call me simple minded but this has to be punished and the individual eventually deported. Period.

There are HUGE criminal issues involved in this case -- the illegal entry/stay is almost secondary to the criminal component...but once again, this is not an occasion for advice/discussion outside of client confidentiality privileges...go see a lawyer in your area, and a good one at that.
