Help!: i140 RFE/already laidoff

Hi,

My I140/485 were submitted concurrently on 11/2002. INS sent a RFE on 2/2003 but that letter got deliver to a wrong address and returned because of company's immigration lawyer messed up the returned address. I got laidoff last month, and RFC finally is re-sent to the lawyer last week.

This RFE asks whether company is capable of paying me. Lawyer has company's related materials so he should be able to provide evidence. BUT he insists that he must tell INS in the RFC response that I'm unemployed now, although this is not relevent to the RFE and I think it's not necessary to tell INS. I'm worried that if he tell this fact, INS most likely will deny my case. So if anybody can give me some advices on how to prevent lawyer from telling INS that. Can I threat him that I can sue him if he does that because he made mistakes to get me in trouble and I pay all the fees.

Which service center did you file your I140/485 ? what kind of documents INS want now ?

Coming to your problem, I strongly feel not to threat your lawyer. You wont achive anything. Try to talk to lawyer thru your employer and politely try to convince him that because of his mistake ur in trouble. If he wont listen, just send response to REE by yourself. I guess, you can send payslips/bank statements/tax returns etc...hopefully ur problem will get sorted out.
 
My case was filed on vermont center. I guess I cannot respond to the RFE myself.

I've tried to talk to them to not reveal it to INS. They just insist doing so to protect their own interests.

wow .. i guess the lawyer is really covering his self., but he technically is doing nothing wring by sending what they ask for ??
