Help! I need to stay!

Hello, ok I am very stressed out. I am from Canada. I married an American and it was all good. We had a son together. Now we are getting a divorce and I can assure you its not fun. However I want to stay here to be with my son and give support to my x-wife. Now my current plan is to head directly to the border and apply for a TN-1 visa and then return. Currently I have a full time job and its a good job. But my status expires on Jan 24th this year so I need something asap. Is that wise? I want to stay here. Of course legally. Also is there a way through my son whom is just 8 months old? I am really nervous and not sure what to do at this point other than head to the border and hope for the best. Thanks greatly in advance.

Can american employers sponsor canadians for work based green cards? If so then that would be another route you can pursue. You will need to find a company that would be willing to demonstrate a need for your skillsets short in supply in the US and can file a work based green card for you.
