Hi,

Does anyone apply for I485 without a lawyer?? My husband and I are very tight in our budget and we are thinking of applying I485 by ourselves.

Does anyone know or have any experiences about this?? Please share your experiences.

Hi, I am sorry I am actually not answering your question but instead have a question for you - do you know if I485 can be applied if you are out of America or should one be in America to apply. My husband is right now there but I am not.
 
Yes, you can apply for Green Card yourself. But you got to be very carefull so that you make no mistakes.

Second Question: If you are applying for Employment base GC then you have to be in USA. If some sponsors you for GC as a family member you don't have to be in US.

Thats it...Very careful...CHeck and recheck 10 times....

Dont send anything that they have not asked for...and dont leave out that they have asked for....

Go by the Instructions on each form...Fillable forms for all applications are available on the net...Look for them,...make sure the version U are choosing is still valid...The info is available on the Ins site telling U which versions are allowed....

Look on google for "485 Fillable Forms" U should get all the needed forms ....They will be of great help...

My husband and I got RFEs 3.5 months ago. They asked for
medical, last year W2 and three months paystubs. They didn't
asked for employment letter. My husband thought it would be
no harm if we had one for them. So we also sent them the
letter along with the documents they asked for. Do you think
that whould be the reason why we havn't gotten our cases approved in such a long time?

I've called IIO three times, and asked our lawyer to call to find
out what's going on. But our lawyer seems does like the idea
of calling them. She just suggested us waiting.

Yes you can apply i485 without lawyer...go to this link for more info to apply...
www.immihelp.com, just double check on the FP fees, it was $25 in this site, but INS has increased it to $50 effective Feb. 2002

I'd like to thank everyone of you who contribute your suggestions.

I have one more question. According to the filling instructions, it seems to me that police clearance is not necessary when filing I-485 based on I-140 petition. Is my interpretation correct? Or did anybody ever get a police clearance when filing I-485 and how to get one.

Yes, I know poeple who have done it. If you know someone who used a lawyer, you could take his/ her help or use this forum also

NOT NECESSARY .. yes that is where I differ from FORMER_PPHILLY. The fact that are employed by the employer who is sponsoring your for GC is just a positive factor for your case, in fact they (INS) DO NOT expect you to file for a GC when you apply for a H1 (recall all those NO you ticked in the visa application at the consulate), so you can be sponsored for a GC by employer who does not even employ you, irrespective of the fact whether you are in US or not !! I hope I made myself clear

Police Clearance - Not required if you are filing 140, this is done at the FP stage automatically, but if you are outside the country, this may be required.

I would still suggest hire an attorney, and structure a payment plan .. it could easily take 3 years .. its just not worth taking the time / career risk ..if you get a RFE you will end up consulting an attorney anyway
