Help, How should I reply to INS's request?

Hi All,

I am cook in a chinese restaurant. The prior owner of the restaurant sponsored me to apply for green card. I have already filed I485. However, the restaurant changes owner recently. INS is requesting the new owner's previous tax records. But the new owner did not have any previous tax records since this restaurant is his first business. How should I do in this situation?

Hi cook091503..

You should consult with your/a lawyer ... when tax returns are not available, BCIS will accept alternate documents, such as bank statements, profit-and-loss statements, etc. My (sponsoring) company was a start-up and did not have tax returns either. Not the exact situation, but similar

My wife filed her i485 in similar circumstances. The advice rajib_rashid is giving you is excellent, on the money..:)
My wife's employer did not have tax returns either and she presented profit and loss statements which they accepted and approved her application.

Thanks All for your help!!!

The new owner of the restaurant is not nice enough to provide me these alternative documents. I may have to find a new employer. I am wondering if I can still continue the current I485 process.

If you hav t ofind a new employer, you will have to start over the whole process of 485. You will have to file new labor., 140, and 485.
