Could you please, please help me with the questions that I have listed below.

My 1st FP is expiring on July 20 2003 (15 months after I gave my FP on Apr 20 2002)

My RD is Feb 2002, ND is Mar 2002.

These are my questions -

1. Will a RFE be generated, when my FP expires. If so, what will it say? Who will receive it??

2. When will the second FP notice be sent.

3. If my case is assigned to an officer and then the first FP expires before approval, what will happen??

Any body with past experience, please help.

First of all dont get panic.

1. Will a RFE be generated, when my FP expires. If so, what will it say? Who will receive it??

- RFE can be generated if there is any problem with your case, not due to re-FP. When your FP will expire, you will get a FP notice. You will receive FP notice not your lawyer. In case of RFE, both you and your lawyer will get it.

2. When will the second FP notice be sent.

- BCIS knows:( ... Before your case is approved. If FP is expired when an officer takes your case, he will first generate re FP notice.

3. If my case is assigned to an officer and then the first FP expires before approval, what will happen??

- He will generate re-FP notice.
Any body with past experience, please help.


Rules are same for every one. you are not an exception.

First of all, thanks for your assuring reply.

I have some others issues brewing, which made me anxious.

And, there were couple of posts which said, a RFE was generated on the same day when their first FP expired.

Also, I heard in this forum that only attorneys receive the RFE.

Do you (or anybody else) have past experience, in receiving a RFE during 485??

Yes, I have eperience of recieving RFE . They come to your lawyer who send you and your company a copy. YOu reply to BCIS thru your lawyer. But you are , i think, confusing RFE with re-FP . re-FP I understand comes to the individual as well as the lawyer, I am not sure. In any case why are you so worried.

My observations/suggestions have no legal validity
 
You and your lawyer (both) receive RFE.
You are the only person (not your lawyer) who receives FP notice.

In my case only my Lawyer recieved the RFE. As per some posts on this site this had been the case with others too. FP you might right, Jay.

In my case Lawyer and I received FP Notice.

Employement RFE was send to Lawyer ONLY.

I don't know about the Medical RFE. I guess, PHOTO RFE's are send only to you. (my EAD PHOTO RFE was directly send to me not to the lawyer)
