Help !! have I got out of status situation for a day ?

I have applied for I-485 in October 2000 and currently I got my EAC valid from 12/27/2000 to 12/26/2001. But my Old H1 got expired on 10/30/2000 and my company filed an new H1 application in September 2000. The new H1 approval came in January but the new H1 valid date shows 11/01/2000 to 10/01/2003. Which it means to me that on 10/31/2000 is don\'t have any status. My company is telling me that it is not going to affect me anything. Does anyone has any experience like this or know what should I do to get it corrected ? Does anyone know the impact of it? Any help will be appreciated.

I believe you have about 10 days of grace period after your
H-1 expires.

I don\'t think you will have any problems. Additionally, I think you can be out of status for a total of six months under section 245(i. However, check with your attorney regardng this.

Hello sdas123,
When did you received a receipt for you H1 application. If you received before your H1 expired, you are not out of status. You can still keep working. Once you received a receipt means, the INS is processing you case. Till they reject your H1 application, you wont go out of status.
