Help!! H4 transfer on lost passport

My wife recently lost her passport. She is currently on H1B. We reported it to the police, but have not applied for a replacement yet.
We have copies of all her documents.
I am switching companies, and the new company is getting ready to apply for an H1B visa for me.
Can we apply for a visa right now, even if she hasnt got a duplicate passport yet? Or can we just use the copies from the old passport?
