HELP!! H4 expiring soon.

Hello friends out there,

My son will turn 21 years old on Mar 2005, his H4 visa will also expire on this date. Our change status application for permanent residency is still pending at the US Dept of Labor, I'm afraid we wont be able to get EAD by that time. Can anybody please tell me what are the options we have, so my son continue his stay here. I wouldn't want to send him back all by himself because he will have nobody there. My wife and I don't have proble,s since our visa is valid until Nov2006.

I have to be prepared for the eventuality, so I would appreciate whatever advise you can give me.

If your LC has been pending for more than 1 year then u can file for an H1 extension.I guess that should imply for H4 too.Check with a lawyer for safe measures.

I guess your visa is valid till Nov.2006 and your child's till Mar 2004
may have been resulted from stamping of H4 at consulate/state Dept,when you sent for stamping.
The H4 visa will be stamped up to age of 21 yrs for your child
as he ceases to be child after that though I-94 may be vaild beyond that.Probably you might also have got 221G form asking
to contact/apply to CIS at Mar2005.
Asess whether your LC will be approved and you will be able to file 140&485 well before that time and EAD for child also.
If the probailty is not that,ahead of the deadline you may apply for F1.
