Help..... H1expiring..

Hi,

I am in a bad situation. I have my H1 limit ending at Jan 2002 and I found it out only now and haven\'t applied the H1 extension. According to other messages, the extension process takes around 3 months. These 3 months, I\'ll be out of status. Still, I have a good job and no problem with the employer.
I have also filed my 140 which is almost done. So what would be my best bet? Should I go to India and wait for the approval of extension or should I stay in US?

Any help is highly appreciated.

Need help

A company was recently started in October. Its a new company, with no history. Its a consulting company and needs people on H1B. As its required the company has no w2, H1 , tax filings , nothing not even a business transaction. Whats the best way to file a H1 for such a company. Can it file at all or should wait for some time and business to happen. Can Mr. Rajiv suggest the best and fastest way.
 
You need to apply for extension ASAP

What you need to do is to apply for extension as before the
expiration of your H1. The fact of having an application
pending keeps you in status, and you won\'t need to leave the
US. You can just stay and work normally while INS is processing
your extension.
