Help: H1b Application pending for 3 years

My Initial application has been pending for 3 years [since OCT 2004], do I need to file for extension like regular H1b holders, or is that not applicable !? If not, is it even possible to stay pending indefinitely !?

Would the starting date be the day of the approval or the original one from the application of 3 years ago !

What is your current immigration status? Do you have an I-94 that covers the past 3 years?

Anyway there is something wrong in this picture. If it is truly pending without adjudication for 3 years, chances are that you will never get approved.

I read your other post and undestand now that you have been out of status after spending 9 years in F-1 student status. Unfortunately filing extension doesn't make a lot of sense to me because the initial petition is still pending and there is nothing to extend.

What has your attorney done to make the process go forward so far? AILA liaison? Congressman?
