I just want to make sure I got the facts right before I go to my lawyer:

My case is like this.

My H1 expires Jan 2005. I have a Regular LC filed in April 2002 with university A. Now my boss transferred to university B, bringing me along with him in January this year (Jan 2004). Can I use the pending LC in university A to apply for 7th year in university B? We had already filed a new LC-RIR in Feb this year, but we cannot use that for 7th year extension since 365 has not passed yet. Also, if I get the 7th year, can I use the LC filed recently for 8th year extension?

Thank you very much!!!!

--YES, you need the evidence of LC filing and evidence is LC filing reciept that lawyer gets from SWA or SEA after the LC is recieved by SESA or SWA the reciept will have your employer name, your name, date of filing and case # if you dont have the copy of reciept ask the lawyer who filed LC. one can file 7th year H1 based on ANY employer filed LC pending more than 365 days.

We had already filed a new LC-RIR in Feb this year, but we cannot use that for 7th year extension since 365 has not passed yet.
-- you are correct
Also, if I get the 7th year, can I use the LC filed recently for 8th year extension?
-- YES if that is pending more than 365 days
