Help From Those Who Have Concurrently Filed I-130 and I-485

Hello everyone, my question is for those who have filed both I-130 and I-485 concurrently. I am in the final stages of preparing my forms (thanks to everyone in this forum) and am planning on sending them this Friday!

Anyway, I have come across some posts where individuals who have concurrently filed the I-130 and I-485 received a rejection letter for the I-485 since "Based on the information you provided, your priority date could not be established.... The following documents maybe provided: You original From I-130 if you are filing concurrently, or..., or a copy of your Form I-797 (Notice of Action) if the petition has already been filed/approved."

In preparing my packet, should I include a copy of the I-130 with the I-485 as an attachment? In other words, if I proceed to do this, there will be 2 copies of the I-130: a signed original and a photocopy attached to the I-485.

Do you think this is necessary to avoid this sort of rejection letter? I would like to hear what you did when you concurrently filed your I-130 and I-485.

The I-485 form itself says: "(Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)"

you will attach I-130 signed just the original make sure to provide every copy of every document they ask

I am one of them. I think the forms we send are very many, they get overwhelmed.:rolleyes: What else can I think of;) Be sure to include a cover letter explaining the contents. That's what I did the second time around - it was the charm:p
 
I dont advice you to attach 2 copies it makes the whole thing more confusing , if you want them not to reject your case out of error, try to make the paper work more simple for them , I made 4 folders (I-130, I-485, I-131 , I-765) , used a different color for each folder, ..printed out a cover letter for every folder and stapled it to the respective folder .. this way its more clear.

That's the way to go. Make sure you clearly indicate which form each folder holds (e.g. write it with a sharpie on the ID-lip of the folder). If they can clearly ID a 485 AND a 130 folder, you'll be fine.

You file both forms I-130/I-485 to the same address in the same package to Chicago.
 
Just one little advice:

Since some forms are expired (I-765) you might want to put a big sticker with big letters saying something like "please do not reject this form since it's the latest available version".

Some people complaint that their applications were rejected because of this expiration problem.

On the other hand, if you are not filing those forms, then never mind.
 
On top of a cover letter explaining which forms I was filing, I also used colored tabs where I wrote the form numbers on the side, that way they could see exactly all the forms I included. It worked, I had no rejections.
