Help - FP notice not received after 90 days of N-400 submission

Hi Folks,

My dad submitted his N-400 application to Phoenix in August. It has been more than 90 days and no FP notice has come or any case movement has happened.

The uscis customer service is total BS. They are asking us to keep waiting. I called up the customer service today and the 2nd level IO told me to wait for another 30 days. Infopass also did not help. The supervisor IO told us that he would look into this but it has been more than 30 days and no reply.

So what are his options? Can my dad file a lawsuit?

Have you followed up with the supervisor?
It's way to early to be able to file a lawsuit. You need to follow up via the regular channels. Have USCIS customer rep open a service request to inquire about it as well.
 
Instantly in this order do the following:

Call USCIS
Make Infopass appointment
Write to Congressman/woman
Contact Ombusdman

Once ALL these things are done (it'll take a little time) THEN you have a few options. Please document ALL correspondence with the authorities. You may need it later.

Can you post your dad's timeline here first, whatever is available. Also, did he receive the case receipt and did USCIS cash the check?

Thank you guys for quick responses..

Here is my dad's timeline:

San Diego DO

Aug 6 2009: Application sent to Phoenix lockbox
Aug 10: Priority date
Aug 13: Checks cashed.
Aug 14: NoA received (This case number printed on the NoA does not show up on the USCIS case online status)
Oct 7: Started calling customer service. Reply: Wait, wait and wait. Called atleast 6-7 times.
Nov 3: Infopass. Talked to supervisor IO (thats what my dad told me). The supervisor said that he would look into it. No FP notice till today. The case status also does not show up online. Called customer service, no use. 9/10 times they give BS answers.

My dad is a retired doctor from India and he needs his citizenship to accept a medical related contract job from the government.

Dad's desparate situation

Hi folks,

I asked my dad to open another service request with the uscis.

Should we write to congressman, senator, etc? Is this a good time?

Could citizenship application be expedited in any way? My dad's contract job starts end of Jan 2010. But the citizenship application does not seem to be moving at all.

He must have the citizenship before starting the job.

Contacting a congressperson or USCIS Ombudsman is pointless at this time since it will likely get you a generic response that USCIS is still within posted processing time. Many applicants fail to realize that the posted processing time is 5 months, so when they don't hear anything after a few weeks they get nervous.
Again, have him follow up with a service request and DO supervisor.
