help..forgot to include marriage cert. copy with I-130 filing.

Hi all,

I sent in my I-130 for my wife to join me in the states. However, I forgot to include a copy of the marriage cert. with the filing.

I have already received the I-797 Notice of Action 1, indicating that my file has been received and is pending.

How and where do I send in this marriage cert. before they send a letter asking for it in the future?

Just wait for the RFE. Sending the marriage certificate unsolicited to USCIS will most likely result in it being lost.
 
will the RFE significantly delay the case?

btw, if you have an idea, How long does it usually take on average from NOA 1 to approval of the I130 request ?

One can't really say how long. Just mail the marriage certificate to them as soon as you get the RFE. Surf the forum and look at other peoples timelines from the same District Office DO that you have or even others to get an idea.
 
What I noticed is that even though they put your case in suspension because of an RFE, the priority date for your case is still maintained as the receipt date. So it may not be a big deal even if you get an RFE. Thats what happend in our case - I got an RFE for birth certificate and as soon as I sent it out things started rolling.

Priority dates may not be revelant here if the OP is a US citizen.

We had the priority date field filled with a date on the I-130 approval notice (the 797 Notice of action), all the others including the welcome notice were left empty. My wife is a US Citizen. So may be priority dates are relavent for the I-130 in this case.
 
Spouses of US citizens don't have to wait for priority dates, as they have immediately available visa numbers. What was the priority date on your I-130 notice? The same as the receipt date? If not I'd say it was a mistake.
 
I'm a US citizen, and I just checked the NOA receipt. The priority date field is blank.

So how is this case different If I am a citizen? What do you mean when you say that a visa number is immediately available?

Does this mean less waiting?

Yes, it means less waiting. Relatives of Green Card holders (as opposed to US citizens) have to wait many years to get a visa number, which is the required first step before AOS can be applied for. For immediate relatives of US citizens there is no such waiting period. The Green Card will be issued as quickly as USCIS can process it.

but what i'm trying to ask is that by being a citizen will our I-130 be processed any quicker so that my spouse can get a visa to enter the US sooner?

Your spouse will get a visa to enter the USA sooner than the spouse of a Green Card holder would, yes.

We are probably talking about the same thing. The priority date on my NOA was actually 4 days before the receipt date. In my case, my receipt date was October 30th and we had an RFE. We replied to the RFE on Jan 16th. The process was suspended till we replied to RFE, but once we replied to the RFE the interview was scheduled as if we applied in October. So all the while we were in the queue, but not like we were taken out of the queue and put back once we replied to the RFE.
