I am married with a citizen one year ago. The I485 is pending. I130 filed with I485 together. My wife want to divorce. She threatened me to sign the divorce paper right away. Otherwise she will call INS to withdraw my application and make me fall out of status right away. I don't know how long it is gonna take for divorce approved. I know when it is approved, I will fall out of status. I even cannot get the air ticket to go back to my country, because it is a Christmas season. Is there anybady know how can I be able to make me stay here a little bit longer(a month more) to book a air ticket. I also need time to finish my classes. It is final exam time. Thanks

If you sign the divorce papers, she/attorney will try to the put the case on court calendar and things will be over as soon as judge gets file on his/her desk.

Also, she can send papers to INS even if you sign the divorce paper. There is no guarantee. I would say contact a good attorney and follow attorney advice rather then getting disturbed by spouse threats.

Regarding pending I-485, you can file under VAWA. Check uscis website.

I called a lawer, but still confused. He told me that I am still legal here until the interview. And I still can work after the divorce before the interview come. I have a little doubt here.

I don't want to go through the batter application. I want to try to reenter by F-1, I don't know the possibility. That is why I am asking how long I am still legal after the divorce. Thanks

Till they deny your I-485 petition.

Please note that you will be having hard time getting F1 (or Visitor visa) after your I-485 denial. You have showed intent to immigrate by applying for I-485 and that might cause problem during F1.
