Help filing I-485 for Mother while in US

I am US citizen, applying for my mother. My mother is currently in US on visitor visa, so I am filing I-130, I-485, I-131 concurrently.
1. On I-485 part 2 which box should I check? since I am filing concurrently and she is already in US but her I-130 is not approved.
2. Can I pay the fee by personal check?

Answer 1) Select option (a)
Yes you can pay fee by personal check and it is better since you will be able to track when your check will be cashed.

1) I don't think (a) should be checked since the visa petition hasn't been approved yet. I checked (h) and explained: "An immediate relative (or a parent) of US citizen filing concurrently.
 
It should be (a). Because it does say within the parenthesis that-"Attach a copy of the approval notice, or a relative, special immigrant juvenile or special immigrant militrary visa petition filed with this application that will give you an immediately available visa number, if approved.)

I do understand where all this confusion is coming from as I strongly believe that there is a typographical error in printing the initial language of that statement because it should have said like this-"an immigrant petition giving me an immediately available immigrant visa that has been approved or if approved."

However, if someone would check a wrong category, then it won't be A BIG PROBLEM as officer would correct that mistake later on, but it would certainly delay the processing for many more months as processing is done by clerks and not the adjudication officers. Clerks don't have time to review each and every document to find out the basis of filing AOS, rather they would just take a quick glance on the category to feed the information in the system. That's why it VERY important to fill out forms correctly and completely.

Name issue

My name on the naturalization certificate and passport says Suresh Patel and the birth certificate says Sureshbhai Patel. I am filing I-130 for my mother and wondering if this will cause any problem? Should I use Sureshbhai Patel as other name used? Any help will be greatly appreciated.
