Help! Daughter's H4 expired can it be renewed?

My attorney messed up my wife's and daughter's H4 extensions in 2004. My wife is back on H4 status but not my daughter. Old attorney said that under "DREAM ACT" my daughter is fine (she is 15 years old). Hence, H4 never extended.

My question is should I extend? What are the implications at the Consulate in India? Thanks.
 
Irrespective of age H4 must be renewed. No one can stay without any status in US.

Thanks. Is it possible to extend now after 3 years gap? My wife has H4 can she go back to India and help in extending my daughter's H4? OR will there be a problem at the embassy? I am scared. I have a valid H1 too.
 
General rule, if anybody out of status in US more than 180 days will be barred to enter US atleast 10 years.


Keeping this in mind, seek an experienced immigration attorney's advise on this matter.

Out of Status can be cleared by paying fee

Looks like your daughter is out of status in US for last 3 years. But I heard that there is a rule where you can pay $1000 as penality and get her status back. This must be the DREAM ACT rule that your old attorney is talking about.

I would definitely suggest you to get an attorney consulation from big Lawyers like Rajiv Khanna or Sheela Murthy. For one consultation it will cost you about $200 to $300 and it will be very helpful. Also it is worth spending that consulation fee if you can get the status back for your daughter.
