I have applied for North Carolina LCA.My state is processed and my Federal will be almost current in a month or so.
If I have a valid LCA,Can I go for Consular Processing of Green card in India, Chennai??
If so, what is the procedure to do so?
Can you share your experiences @ Consular processing in India??
Is there a risk factor associated to it?
I have been told that if the Consular processing gets rejected, I cannot enter United States. I still have a valid H1 though.

Any comments will be appreciated.
Thanks in Advance.

{You probably mean LC (Labor Certification) and not LCA.
Before you can think of the interview at the consulate you
need to go through the I-140 approval process. Once you
have your LC then your attorney would apply for I-140
with the 'CP' option. If you made up your mind about this,
it is very important to indicate AT THE TIME OF APPLYING FOR
I-140 , that you wish to go for the Consulate Process}

If so, what is the procedure to do so?

{As above}

{Go through the CP thread and there is more material than
you can possible read}
Is there a risk factor associated to it?

{The risk of denial is very little and only due to reasons like
fraud, misrepresentation, unlawfull stay and some
communicable diseses. Read the thread}
I have been told that if the Consular processing gets rejected, I cannot enter United States. I still have a valid H1 though.

{If it is for submission of some documents then they may
allow you to visit US, but if it is one of the reasons cited
above, then , even if you have valid H1 visa, they may not
allow you to come back}

Any comments will be appreciated.
Thanks in Advance.

{my responses}

On the whole CP process is quick and in major number of cases, smooth.

shanmugam1174:

If you opted for 485 then you will have to file for I-824 to change from AOS to CP.

If you left the option blank in your I-140 form, then once it is approved or for that matter even now your attorney can send a letter to BCIS informing them tht you would like to go ahead with CP after I-140 approval.

I didn't mention CP in I-140 , after I-140 approval can i change to CP ?

While concurring with the above post I would like to add that
you need to consider the consulate you belong to, before you
proceed with I-824 filing.

If you belong to Chennai consulate, then you will need to
wait for the I-824 approval before the consulate fixes
your appointment.

But other consulates accept AC140 cases. Research the
forum on this topic.

Our attorney accidentally left the CP option blank and filled Chennai, India for the Consulate in one of my colleague's application. He found out the mistake after I-140 approval and INS did not allow him to go for CP without fiing I-824 and he is doing AOS now. Attorney did sent a letter to INS about the mistake but they did not forward the I-140 approval to NVC.
