Help - concurrent filing 140/485 in Sept to VSC Rejected

EB2 PD: Jan 2001 VSC

Fedex 9/27/2005, received on 9/28/2005 according to tracking number

My attorney told me that VSC made a mistake on calculating the application fee and rejected 140/485. And the rejection letter stated that I can only re-submit 140, not 485 due to retrogression.

My attorney told me that he will make a dispute since it's VSC's error and re-submit 140 with 485 to see if VSC is willing to accept it.

Does anyone has similar situation? And what's the solution if there was any?
 
VSC guys do stupid mistakes like this. They wouldnot even care, that tey are playing with people's lives. Mine was sent back on Sep 22nd with the reason like G28 was not original. My papers went on Sep 14th initially. They would not have to send back papers for that reason. They can always put an RFE. Luckily I had one more week's time so, sent thouse papers back in time.

When did your papers come back?

I am sorry for you. Please let us know if you make any progress. I wish you goodluck. By the way Did they send all the papers back along with letter or just the rejection letter?
