Help: asylum seeker

Hello, Can you please help me identify if I can qualify to apply for an asylum in the U.S.A?
1999- the year I left my home ( Ethiopia) to Greece. I was forced to migrate because of my Eritrean back ground.
1999- was denied my Ethiopian citizenship at the Ethiopian embassy in Greece because of my Eritrean heritage.
2003- received my Eritrean passport from the Eritrean Embassy in Greece after four years of my request to the Eritrean Government. They said I was not Eritrean (I don't speak the language, I've never been to the country...)
2003- received Greek work permit.
2005- left to USA to study at the University.
2013- Eritrean passport renewed till 2018.
2005-present under F1/OPT I am what they call non-traditional Protestant Christian. ( which the government likes to persecute). I cannot go to Eritrea. The government is dictatorial...they persecute, imprison, and kill people. I have no evidence to show that this will happen to me. However, it is happening to many Eritreans since 1999. Please let me know if I can file for an asylum in the U.S.A? I never filled for the fear of being denied and deported to Eritrea-an open prison. Thanks for your help in advance.
 
You could apply ... but you have big question waiting for you. You have country where you could live there safe which is Greece, why would you applied for asylum in U.S. ?!
Any way if you keep you status as F1 student don't worry no one going to deport you outside U.S. even I you got denied.
You need to talk to lawyer about that.
 
Asylum seeker, I need your help, I applied for asylum and got NOID, do you know a good lawyer to write a rebuttal?. In case I got a final deny, can I apply again for asylum when I'm out of status? Now, I'm in F1 status. Thank oyu
 
Which state you live in ?!
I'm not sure but I think you could apply again whether you are in status or out of status if you got new circumstances or something changed in your country or life related to your asylum.
 
I think you have a reasonable case but it's important that you provide proof for the following:

1. You are an Eritrean citizen. Eritrea is the only place you can go to and you are not firmly settled in any other country. You need to show that you cannot firmly settle down and receive asylum in Greece (coz you received a work visa there before so why not go back?)
2. If Eritrea is the only place you can go to beside the US, you have to show that you will be persecuted by the government if you go back. This is the more important part and will form the basis of your case. You need to find information from credible sources (think news reports by a legit media outlet, country report by the US State Department, CIA, etc). The responsibility of proving all these is on yourself.

Now, this might be hard to do entirely on your own so I think it's a good idea to find a lawyer. PM me if you're on the east coast.
 
Hi all i need help . I was about to file asylum but our country was granted TPS . I wasin f1 when my TPS was approved later i was not able to continue my f1 since december 2015 .so my current status is TPS . So when can i apply my asylum case ? Does my asylum case will get affected due TPS . I dont have lawyer i am seeking your help please suggest.

You could apply for TPS and asylum at same time. They not going to affect each other. By the way, if your country granted TPS that's help your case. You need lawyer to help you explain your situation and why you applying for asylum.
 
I am no longer on my F1 but i have TPS due to natural cause in our country . So do i have a time frame when should i apply ? Because previously i was in f1.

You need to apply for asylum before the end of one year from your last entry to U.S. If you already pass one year deadline you still can apply but you need good reason and good explain why you didn't apply before it.
 
I was in status before so i didnt apply.
It's ok if you want to apply now, after one year of your entry into the U.S. I did that, too, but you must have sufficient reason to support why now and not before. You should find an attorney to help you with this. There are a few that will charge low fees if you can proof you have income lower than a certain level.

Only because you were in status and chose not file for asylum within one year might not be sufficient, but an attorney will know better.

for the purpose of asylum , your TPS status would be considered as legal status. which means if the asylum office deny your case it wont be refereed automatically to immigration court
