my 6th year H1B is going to expire in 28feb2008. i applied for labor on sep2007 and got approval in Oct2007.then i applied for I-140.can i get 7th year extension now?

if you get I140 approved before H1 expiration, you can get 7th year with H1(provided your PD is retrogressed).

If not, it's a bit risky path, but technically it should work... Going out of the US before H1 expiration and stay out of the US until I140 got approved. Once you got I140 approved, you claim the absent period with H1 and come back.. If you want to take this path, you had better consult with lawyers.

Do you have any time to recapture? if so, extend ur H1 for that time and hope that your i-140 gets approved.

I was in the similar situation, but luckily for me, there was premium processing of i-140 at that time.
