Help !!!!!!!!!! AP or H1B

Hi ,

  I got an RFE for AP on 15 th MARCH.
  My Attorney replied to RFE on 28 TH march.
  Till now i did not get any approvel.
  I am worried that INS stopped processing because of restructering .
  after 3 weeks on april 16th the message changed to RFE reciived and
  it is taking between 60-69 days to process this case .
  
   I have to goto india beacuse of emergency.
   I have valid H1B ,with valid Visa stamping on passport upto 2003.
   The question is can I travel without AP ?
   can i use my valid H1 to enter into USA ?
   If i travel do i have any problems in future .
   Please post your experiences and sugessions here ...
  
Other info : EAD is approved ,FP is done.

Do I need to show the 485 Original filing receipt at the port of entry ?
or this is only a precaution ( in case if they ask ? )

If U haven\'t used your EAD so far(though u have got it) and still working in H1, then U don\'t need an AP..U can travel with your valid H1.
Only once u start using ur EAD, H1 becomes void and U need an AP in that case...

Need AP if

As per my lawyer if you are out of country (USA)and the I485 approves then one should have AP to enter to US since after 485 approval, H1,H4 becomes invalid.

Just for information purpose and please verify with ur lawyer.
