Filed I140 +485+EAD+AP last year, and 485 is still pending. Just got admitted by one of my dream schools recently and wanna go back to school. Here is my plan.

Right now Taxes is processing cases filed in July 2001, so it will probably take two years for BCIS to touch my 485 case( it is funny that I hope BCIS is slow this time) . Meanwhile, my wife's company is about to file GC petition for her. It will take a year and a half for her to get LC approval and file 140 +485+AP+EAD, not counting PERM being implemented this year. Hopefully, I will be covered by her GC petition as her dependent by the time BCIS touches my GC case. While I am at school, I could use my EAD card for intern if necessary and use the EAD based on her petition to find a job upon graduation. If I receive any REF before she files I485, I would try to switch to H4 and finish the school since there is a month to response to the REF and that will give me some time to file a H4.

Is this plan doable? By doing so, do I abuse the law? Gurus, please advise.

Same situation

I am roughly in the same situation and am desperately seeking advice. My I-485 RD is May 2003 ... so I probably have about a year or little bit more. I have got this great offer for PhD studies from one of the best schools in my field starting Sep 2004. I need to know what my options are:

1. As my 485 is pending over 180 days, can I use AC-21 ? Will the university research job qualify? It will be in a similar field ofcourse but the salary will obviously be lower. With the tuition waivers ... it'll be 75% of LC salary.

2. My professor is willing to be flexible enough to allow me to work and study for the first year. If I take up a new job in the same area and take courses for the first year, it helps ... but it obviously lengthens my study period.

Do any of you have any ideas or examples about this? Your input on my options will be very much appreciated.

have you got your approval

have you decided yet? one of my friends is in the same boat, but it is likely he will postpone.

Good luck!
