Hi,

Here are the details of my situation:
WAC-02-040, RD-Oct 2001.
I was laid off after 180 days of filing the I-485.
EAD expired on Feb 2003.
Applied for EAD renewal on Jan 2003.
INS issued an RFE on March 2003 for EVL< paystubs and tax returns.

I have job offers and was waiting for 90 days to get my iEAD.
Went to local INS this morning.
IIO said, we already have issued an RFE on this case, and cannot issue iEAD until RFE is cleared.

I have to now respond to RFE first for them to issue me a temp. EAD.


What are my options?

Please help!

what this is so weired they issued the paystubs/EVL/W2 rfe for EAD. what the F.... was the IIO thinking.this is new rfe and have never seen it before for EAD . Are you sure its for EAD not for your 485.

You can always reply the RFE with new job letter salary and type of job and tax retuns and use AC21 and clear up up your RFE .

RFE was for 485....forgot to mention that....

My Q is: Since i dont have a valid EAD< i can only respond to RFE with old paystubs and new employment letter....

Will this do?
 
yes you can ....as long as the employer is willing to hire when you have legal authorization to work you you can respond with the letter using AC21 . only yhting is will that employer willing to wait for you for another 60days. I read somewhere on this fourm if ins doesnot take any action on rfe for 60 days of receipt of rfe then you can go and get your ead. You might wanna check what any good lawyer has to say on this.
