Hi Dears,
I'm Egyptian citizen , On year 2000 my parents and my little sister immigrated to the united states and they applied to me as a unmarried son over 21 (Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN) and my periority date was 21 Jan. 2001 and they asked from us to wait 815-825 days to make a decesion in our case and i kept waiting this decesion and they took along time to reply actually.
After more than 1500 days,on April 28, 2005 they sent to my dad that our case has been approved and our papers transfered to NVC to issue the visa to me and i kept waiting more and more...
I got married on 2006 and i sent to NVC on september 2006 to update my case to let my wife join my case and they sent to us again on October 2006 telling that our case sent back to USCIS for more reveiw and more processing .
lately they sent again and said that my father has to re-apply as my status has been changed and i think i'll lose my periority date..
shall i appeal or what?
and will i loose my turn in the queue??
is there any solution to avoid all thesee
hope to find a reply from an Immigration Specialist
N.B:
1. My other sister and her family immigrated on last November through the DV program. and now i'm alone here in Egypt and all my family in the US.
2. My Parents and my little sister became an American Citizens on Aug. 2006

is there any way to go to them as a visitor even and to set my case while i'm in the US or to get a Green Card?
waiting your quick reply

Sounds like you have all the family you need right there to me. Why are you so bothered about moving to the USA?

Dear,
we're as Egyptians appreciate the social relations and i want to go there because almost all my family in the US and to reunify my family..
pls if you have any suggestion or solution tell me
thx in advance

Well, by getting married you pushed yourself into the Family 3rd based category, which means your priority date currrently is April 1999. I'm not sure why your father would have to re-apply, that doesn't seem right, but even if he didn't you're still looking at 2-3 years more wait before you can get an immigrant visa. In the meantime you can certainly attempt to get a B-2 visa to visit the USA. However expect them to scrutise or even deny you for it, if they in any way suspect that you would not return to Egypt after visiting. Right now I would say all you can do is wait. Your father probably wants to talk to a lawyer about the I-130 issue. In the meantime, enjoy the family you have around you. You have a new wife and baby on the way. I'm sorry that the rest of your family left you behind, but I guess thats how life is sometimes.

Also you should be glad that the USA allows for the type of family immigration you want to get the benefit of. Most countries don't.

if your parents became US cizitens before you got married, you are OK and you didn't lose your priority date. Howeverm if your petitioner got US citizenship after you got married, you did lose eiligibility and your priority date, and now you have to start from the beginning.

What if you don't notify USCIS about your marriage. You first tell them about your fathers change in status to Citizenship which will put you in First preference and then after you get a letter tell them of your change in status to married putting you in Thrid Preference. Is that doable or are they going to pull a 360 on you and tell you that the day you got married you father was not citizen therefore your 1-130 is trashed and you need to reapply and get a new PD?

My Dad is a Permanent Resident... and I just got married.

My Dad has his N400 in process and should be naturalized within the coming months. I was hoping to just wait till he naturalizes and then have my app upgraded to First Pref. Once I am called I will notify USCIS that I got married.

PraetorianXI, please read the post carefully. I don't lie of condone lying. Like I mentioned, once called for GC notify USCIS about the change in marital status. Its timing and not lying and I don't even know if it will work since the wife is now pregnant.
