Hello, any one out there:

I have one quick question. I have GC and is planning to go back to my home country for less than one year but more than 6 months. Do I need to apply for re-entry permit?

My lawyer's letter said I need to apply for reentry permit. All my friends told me that I need to apply for reentry permit since I am leaving for more than 6 months.

However, I find no legal grounds for this 6 month timeframe. My GC approval notice states that you should only apply for reentry permit if you plan to travel abroad 1 year or more. I go to INS website and take the eligibility test and it says that if I only travle abroad less that one year, then I don't need a reentry permit.

So, who to trust? What should I do?

Thanks for any advice.

Rebecca

No need for re-entry permit. But return after >6 month
is seeking re-admission. You should oroally
convince the INS that you did not abondon your
residence in the USA and submit yoruself to
those admissibility criteria (criminal background,
polygamy history, totalitarian party association,
prostituon, public charge etc).

You also need to convince the INS not to re-set
the clock toward citizenship

I also left from the US after staying there for 2months and 25days(almost 3months). Its been 4months and half that I am out of the states. I'm planning to return to the states in 2months, which is after 7months-totally. Im here for my last semester. Would it be enough statement at the POE not to re-set clock towards citizenship and for letting me in to the states without any problems?

For a single 7 month trip for the purpose of completing your last semester, you should be okay. Citizenship clock gets reset for trips greater than a year in length.

Decisions regarding your citizenship clock will not be made at the POE; it is at the citizenship interview where you will have to convince the interviewer that you maintained continuous residence during that 7-month absence. You will need to provide proof of ties to the US, such as bank accounts, lease or home ownership documents, utility bills, etc. as well as showing that your time abroad was for studying and not work.
