Finally, heard this case has been approved.

PD - 10/99
RD - 1/8/01
ND - 1/16/01
FP - 5/3/01

AD - 12/13/01 (just heard on AVM... yesterday was same old tune )
              (same message today morning \'Your app.\' etc)

EAC-01-079-5xxxx

India / EB2 / 140 CP / No RFE

140 was requested by INS sometime in october and NVC confirmed that
they sent the file back to INS on 2nd November.

Called IIO\'s several times but no good info. was given.

It seems my lawyer didn\'t send anything to NVC.

I talked with him and he told me there is some kind of screwup in the CP system. INS approves 140 and sends it to NVC. NVC supposed to send xfer 140 electronically (initially) to consulate but due to some kind of error the physical petition was sent.

**** (Physical copy of 140 should remain at NVC storage).

In my case, when I checked NVC some time in september\'01 they told me they have sent it to consulate because my attorney never responded to the letter.(auto message used to say \'ON Jan 12,2001 we have sent pkt3 with forms to attorney on file.Send pkt3 to chennai.blah.blah.)

But when I called end of october that version has changed.
On Nov 1st wk auto message changed to \'We have recd some info. that applicant is adjusting in US so we held the petition in NVC and we will send that back on INS request).

The final conclusion to this is

INS can easily track the 140 petition and know where exactly it is sitting.

\'If you file is physically sitting in chennai INS directly contacts chennai and they will send it directly to VSC\'.(on VSC request).
NVC is not involved in this kind of request.

\'If the file is sitting in NVC storage INS sends the request to NVC\'.

I am in the same boat.
PD = 06/99
RD = 12/00
ND = 12/00
140 is for CP and No RFE so far.

I came to know that my 140 is for CP only last week.
Then I called NVC and got the message "we received your intent to adjust status in US and we will hold it till INS requests it".

Also, called INS and was told that they are waiting for my 140.

Do I need to call INS now request it?. Did you do that?. Did you called any one i.e. INS, NVC or Consulate after your message changed to this.

How do we know when NVC sent our file back to INS?

Please advise.
 
Hi dec2000 ... you can call NVC to check the date of shipment...

They are prompt in telling the dates.

I think give it a month and you should get your approval.(There is delay in receiving mail as you know).
