Have you used someone else's Approved Labor ?

A company is willing file I140 cum 485 directly using someone else’s <b>approved labor </b>. Please advise me.

it is not as easy it sounds ..read this..

It is not easy to use LC approved for somebody else. I won't do it unless I am desperate ( 6yrs expiring ) to survive.


The education, skillset, experience everything should match most, 80-100%.

If the original LC is not with the company/attorney, DO NOT DO IT. It is going to take cool two years. Because original LC might be with DOL ( not BCIS/INS). BCIS/INS need to request DOL and get it from them while processing the case.


If the original LC is with the company now, you may go for it and wait until EAD/AP are approved. That way, there are chances that they reviewed your info with the approved LC. I would wait until EAD is approved to switch jobs.

If the sponsoring company is willing to pay for it, go for it.

Ofcourse, we cannot prevent anything from happening. Good Luck.

Urgent help needed!

I have a problem. My labot was approved from Memphis(state and federal). I got layed of after I applied for 140. I joied a new company which is just 5 miles away from the original company. Can I use the old labor and start my 140 and 485 process. Please let me know.

LC is for a position not for a person

Dear,
LC is for a "position in a company". Not for an employee.

Your ex-employer can use your approved LC for anyone.

You need to start from the scratch. Sorry to say that.

I feel your pain.

It was pretty easy for me.

Matching the skillset shoud be easy. I got my 485 approved with substitution labor. Both of us were Windows programmers. The salary does not matter if its atleast equal to LC.

I dont know abt LC being with DOL. My 140 with substitution was approved in 3 months in 2001

NOw the scene is diff, the DOL or SESA are fully aware of the situation and the tactics used by companies.
Therefore, you will now see the NOF with the reasons /; where are the beneficiaries etc.

One should be very careful when going for lab, subs. And if you have time then go for your own labor cert,
