have a pre-approved labor, can someone use it

Hi,
My friend's company is offering him a pre-approved labor. It will be an EB2 labor and his company has agreed to file I-140 and I-485 together as this labor does not fall under retrogression.

Few months back, I heard that USCIS is going to disallow use of pre-approved labors. Is this a law yet?
If not, should my friend go ahead and use that labor?
