has son aged out??????

This is my first posting and hope it is in the right area

can anyone advise if my son has aged out?


1. My husband filed I 485 in Feb 2002 listing all family members
he indicated that he and youngest would file in US and my other son and myself would file in the UK as he was in the middle of a degree at the time.

2. we were advised to submit I 824"s for myself and son which we did and was denied as only the I 140 was approved. We received a letter from Texas saying to re-send once my hubbys I 485 was approved.


3. My hubbys I 485 has been approved on 13th April 04 and son is now over 21

Does anyone know if he has aged out? if so can we ask that the I 130 be expeditied?

I moved to Florida in Aug 03 and in change of status myself, so my poor son is living in the UK whilst the rest of us are here.

He did have an L2 which expired on his 21st Birthday

I also filed I-485 for my family in February 2002 and my son has turned 21,
so your situation sounds similar to mine in a certain way.
I'd like to advise you but I'm not sure how exactly your son's situation is.

Did your husband file I-485 also for you and your older son ?

Is it related to AC I-140 and CP ?

Did you file I-485 for youself ?
What is your current status ?

In case of your son's aging out,
PD for FB preference 2B for Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents is 15MAY95.

Hi,

We were told that the only ones who could submit I 485's were my hubby and youngest son because they were resident in the US and the other two must submit I 824's to be delt with in the Uk

All family names were listed on hubbys I 485 saying 2 of us would need to be delt with in the Uk

As my L2 was to expire in Aug 03 I jump on a plane (before it expired) and sent in a I 485 for myself so am currently in change of status. I have a notice of action which says my case (Texas) will take 990-990 days to process

I am sorry I do not understand what you mean by is it related to AC140 and CP

All I can say is

My hubby have I 140 approved in May 2001, application for I 485 in Feb 2002 (both before sons 21st) sent I 824's (before sons 21st)

Husbands I 485 approved 13th April 2003

I don't know about I-824 so much,
but I wonder if I-824 application for your son is still alive.
You had better talk to your attorney.

In my son's case, we decided not to leave the United States until we would get green cards.
I received a letter from CSC Director Don Neufeld to confirm that CSPA would protect my son from aging out.
Instead, he rejected my expedite request.
