Hello there,
See if you guys can help.

I try to renew my Computer System Analyst TN status at Vancouver airport POE last month. The CBP asked me for the sworn statement and asked me for my daily job activities. I didn't lie to him since I was traveling with my 6 years old son. Don't want any trouble.Truely, I have been helping our engineering department for some mobile electronic projects in the last few months. He found out that I am not in the computer related field and the renew is refused. He gave me a finger print and a copy of sworn statement. He said this is a withdraw, NOT a refusal.

My question is:
* Is there a difference between withdraw or refusal? Is this statement record showing in the CPB database and become one of my record in the next TN apply? Will this affect my future TN application?

Few days later, I try to cross the boarder by land (Blaine,WA). I thought I can cross for tourism reason. But again, I went to the secondary inspection. The CBP didn't allow me travel to state for another 5~6 months until I show some establishment(paystub, utility bills) in my home town Vancouver. At last, finger print again and drove my car back.
My questions is: Will this record show in CPB database too?

These issues look like I got refused for twice in one month. But My work experiences help me to get another new job offer under TN. I am going to the boarder again. I am concern that the last refusals will make me more difficult to apply a new TN status.

Does any one has opinions, suggestions? or experiences like me? Thank you

Dave

A withdrawl is slightly better than a refusal, since it allows you to fix the problem and try again.

Unfortunately, since you decided not to fix the problem, you now have a refusal of entry on your record, too!

Tners at the end of status, whether by choice or not, atre not typically allowed to re-enter US as toursists until they firmly re-establish Cdn ties (lease, utilities, etc) and furnish such proof when entering US again.

To the CBP, you looked like someone who was denied TN and was simply trying to sneak back into the US to work illegally.

If you present a proper TN application, you should be admitted. However these marks are on your permanent file.

Is that mean? Whether I have a strong & proper documents (Well prepared Job Offer Letter and job Resume, Bachelor's degree of Computer Science Cert). The CBP still look at my history and deny my NEW coming TN application?

Is there any legal service or law firm can help to review my case or my documents? I am okay to pay consultant fee. Just to make sure I have better chance to convince the CBP office at my new application. Thanks

Dave

You have not been barred; you were merely denied entry -- and told what to do by CBP:

1. to enter as TN, you needc to provide proper documents showing that your job duties, education, and TN classification match; nothing new here. A resume doesn't matter. A job offer letter is usually not good enough.

2. To enter as tourist, you need to have a Cdn residence established.
