Has anyone ever applied for an FOIPA to USCIS itself? I am thinking about sending one to release info regarding my file. Can you advise?

Yes, all USCIS offices have FOIA units in them that respond to FOIA requests. The only concern I would have would be that the FOIA unit would have to request your physical file from wherever it is currently processing (assuming you have some application/petition pending on your behalf) to make the copies and get them out to you. My guess would be that one of two things would happen--1) the FOIA unit would request the file but not get it (and not get you the copies) until your pending application is resolved or 2) the FOIA unit may get priority and get the file and pull it out of whatever queue it's in. i'm a caseworker in a congressional office, and I have definitely seen the first scenario happen, but i don't know what the odds are of the second. in any event, yes, you can FOIA your a-file. sorry for a long answer to a short question. :)

O thanks a lot for the info my friend. No trouble. The more you type the better. :) Knowledge is power. ;) I will probably wait until my Naturalization case is resolved, then file for one.
 
I spoke with a lawyer and was told that he will file an FOIA as soon as I hire him. He was confident that he will receive a reply, and that it won't slow the process down. So what do you think?
 
I have seen attorneys advising to file FOIA first, then file N-400 after getting the copy. In any case, it is more meaningful to have the copy of file prior to filing N-400.
If your file is under any process due to your filig of any applications like N-400, you will not get the copy of file against your FOIA request.

Well I am waiting for a decision to be made on my case after my Interview. The lawyer I spoke with said he can get the FOIA. Does he know what he's talking about?
