Has anyone Changed Job based upon 180 day criteria of AC-21

I have copleted more than 425 days since filing I485 and thinking of changing Job but I am confused because INS is telling me that my case will be decided in two months..I am curious to know if any body has changed the job based upon new law following the 180 day guideline? if yes What documents are required? And what should I do?

u cannot change jobs till legislation becomes INS regulation. That woul happen by Mar 2001.

I would suggest you wait especially since you are that close... INS has mentioned in AILA conference call that the regulations on the new law covering this aspect will be published in Mar 2001. Hence, if you really don\'t have to then don\'t or else change now becuase you will at least have a case that INS didn\'t issue regulations soon. If you make a switch after the regulations have been issued and if they say portability applies to I485 case filed after Oct 17, then you may have no chance of approval if they issue an RFE.

Thanks for the replies but My company has declered bankruptcy and people are telling me that this can negetively affect my GC.
Also I am EB3, RD- Sept99, ND Oct99 PD- Dec98 and FP Sep 2000.

I-485 and RFE

I recently received RFE(for Form G325 - Biographic Information). Here are my details :

Category : EB3
PD : 07/10/97
RD : 08/99
ND : 09/99
FP : 07/00
RFE : 11/00

What does all this mean? Does INS really work by PD\'s or they will wait till the date becomes current for the category before approval? Quesions or Comments?

I think they go by PD reardless of evrything else. Thats what my lawyer and other people on the MSG board says.

my guess is they are assuming PD to go current for next year so are preparing all approvals right away. so sit tight. you might get it on response to your RFE.

INS always goes by RD/ND and then they look at PD. Even if the PD is not current, they can still issue the RFE which doesn\'t mean that the case will get approved right after RFE is answered.. this may be what it is (ofcourse you have to take into account the booboo\'s INS commits from time to time).

I would suggest you change the job in stead of suffering from your current situation. I noted that there is all kinds of answers to your question on the web, every lawyer gives different opinion. The law is pretty clear, and the INS FAQ is also every clear about the portability. However, it is true if INS really want to screw you up, they will! But remember they can screw anybody they want even if those innocent and poor immigrants-wannabe do everything to comply with the rules.

So my suggestion is: just control your work and life by your own hands, not INS\'. And if the time comes to fight, then fight them!

Sorry to hear that Hanuman!!, yes in your case you have no option to make use of the new law to the fullest extent you have to use the portablity clause, although INS has not yet given the implementation of the law yet but soon it should, but you can be on the look out for the new job according to the statue of portablility and take it. If you have enough time before your job is in jeoperdy then wait till the last moment and have a job lined up for you and when the time is ripe jump.
