has any one done labor substitution

Hello all,

My employer is trying to substitue labor of a old employee . They are going to do the concurrent filing. Has any one had experience in using the labor substitution. What could be the problems we may see ? How eaxactly this thing works ?

Please share your expereince so that I can take measures in my area of influence.

1.Find out the Date of Applied the Original Labour , and Make sure that year company financials are GOOD . (Other wise u get RFE on "Ability to pay")

For Example if Original labour applied on yr2000, make sure that yr 2000 company in positive side

2. Education ---has to match

3. Shilss & Experence In Labour --Has to Match..

I have done labour substitution, but I had opted for Consular Processing.

I am not much experienced in GC stuff. Just started learning/researching after denial of my I-140. (Still trying to find out the reason for denial.!)

Thanks for the reply. What is consular processing ? You still have visa ? . I heard usually substitutions are little bit risky.

My educational qulification(Masters) more than the labor(Bachelors) in the same area of study.
Even the work experience is very similar. It approved in 2003 it seems. That time our company financials are good.

Do have any guess why your I140 denied ?

as long as company financials good and your education Quali and Skills match to Original LC .... i belive you are fine .....M
----My I-140 was not denied .. Got a RFE reg "Ability to pay"
