Harrisburg SESA always issues a case number at SESA and Philly DOL without issuing a case number would not even look at your file.

One thing you can do is try the AVM give your Employer TAX ID or phone number and see if there are any cases in PHilly DOL
 
At last moving forward

Hi Guys..

I started my GC way back in May 2001 at Philly SESA with my previous employer, it never got moved to DOL till I left my previous employer and joined the current one in Dec'2002. These guys took a longtime to file and finally filed it on Sept'03. I came to hear that now the file has moved to DOL.

I hope it moves faster now in DOL......

did sesa notifiy your employer when they moved your file from sesa to regional office. did they give you any case number?.

Harrisburg SESA

Yes, They informed my attorney. They do not inform the case number.

You can find out the case number by dialing 215-861-5286, option 1 and then option 2 and give the telephone number on the part A of labor application. If your company filed a lot of applications then it is difficult but can still guess by the date it was recieved. In my case mine is the only case ever filed.
 
Does Harrisburg SESA provide receipt of LC filing?

I expect to file an LC in Harrisburg SESA in the near future. Does Harrisburg SESA provide a receipt for an LC filed there? Please let me know, it will help me very much. Thanks.

Filing LC in Harrisburg

I am about to file. I was told by my lawyer that Philadelphia office is no longer accepting new applications, and we have to file through Harrisburg. Will the Philadelphia office be closed so they can combine the work force in Harrisburg? Seems Harrisburg is very slow. Thanks.

Processing Time Has Moved Dramatically?!

If my memery is correct, Harrisburg reported processing Sept 2003 cases in Aug 2004. Now in Spet 2004, It is saying to be processing Feb 2004 cases. Sounds too good...

Also now according to the Philadelphia reginal thread, all pending cases there have been transfered to the backlog reduction center. Where will the approved Harrisburg cases go? Any updates from earlier applicants will be greatly appreciated.
 
pre-approved labor

I am looking for a pre-approved labor.
I have 9 months left for 6 yrs on my H1 visa to end.My current employer applied for my GC- but I don't think they company will survive that long.

I read somewhere that approved labor from Harrisbur(SWA) will go to federal as normal channel.
But un-opened cases will suffer among others in "backlog reduction" centers.

Mine was filed in July 2004. Based on the latest DOL memo, my case would be sent to the BEC waiting. I do not know if I still have the patience to wait again. Thanks.

I am not sure I understand that memo right.

My filing date is May 04 with Harrisburg SESA. Here's how I read it.
SWA's will continue adjudicating State cases until Dec 04. All cases adjudicated bu Dec 31st 2004 will go to the Regional DOL.
What then ? Does DOL forward these to BEC ?

All cases unopened until Jan 01 2005 will be forwarded to National Processing Cntr in Atlanta.

Is this correct?

I guess at this point it's pointless to speculate whether BEC or NPC will be faster. My rationale being that by Jan 05 BEC's will be operational and already adjudicating cases. Especially with Philly Regional cases, if operations begin by next week (as expected) then we may actually see the entire backlog of 11,000 cases adjudicated by mid-Feb 05.
If NPC's initiate processing efficiently, we may get adjudications around the same timeline but there's the big question on efficiency especially with a new process in a new center.

Either way - if you're an EB3 from China or India you may be out of luck what with the visa numbers expected to retrogress in 05. But that doesn't mean one would stop hoping for an earlier labor adjudication....

Please share your thoughts about the BEC / NPC workload in context to the memo.

Here is my understanding of the memo.

Yes. State SWAs are supposed to work on cases on hand until Dec. 04. But at the same time they are in the process packing and sending cases with older PD to the BECs at this moment according to the memo. By March 05, all unopened cases filed before 12/31/04 will be sent over to the BECs. Any cases filed after 12/31/04 will be forwarded by state SWAs to the NPCs, if PERM is not in effect by then.

Even if Harrisburg speeds up for the last two months of 04 and finishes processing all the current pending cases on hand, where will the cases be forwarded to? Phillie DOL is no longer functional in terms of processing LC cases. So Harrisburg would have to forward them to Phillie BEC, where FIFO will take place. The BECs would have to process pending cases filed in 01, 02, and 03 nationwide before processing 04 cases.

Unfortunately, I fall into the category of possible visa retrogress. I hope PERM will be published soon. Then at least I will have some other options to get pass the first stage. I am not in IT. Thanks.

Ok, so it seems that Harrisburg SWA has moved up a month. Which is good news. I am hoping that my case which was filed in May 04 should be processed by Harrisburg in the next month or (dare I say) sooner :cool:

I am beginning to comprehend the rules created at the BEC's.
It sounds like the Philly BEC is processing Philly DOL cases first.
Given that and what you have said above, it sounds like all cases approved by Harrisburg SWA in the next few months will be forwarded to Philly BEC and put in the FIFO queue for the Philadelphia DOL backlogs.
If that is the case, those of us who get cleared from the Harrisburg SWA may finally get lucky. God knows Philly SWA and DOL applicants deserve a break, there has been no movement for a year.

I think it's a matter of getting a little lucky with respect to timing of SWA approval and transfer to Philly BEC so we can make it within the BEC's processing of Philly DOL backlog cases. After all, it's a software system that creates 2 queues, one for RIR and another for non RIR. Then presents cases to officers based on the FIFO rule.
It is expected that the Philly BEC will process all Philly DOL cases backlogged in a matter of 2 or 3 months... maybe it's not too late to be optimistic. :rolleyes:

Hi,

My Labor was filed with Harrisburg office in Phialdelphia in May'04. The processing dates show that they are processing as of April'04.
I would like to know with the new rule coming in to /or already come I don't know , the unopened labor applications filed will be sent to BRC or NPC(national processing center)??

What is the difference bteween BRC and NPC??

I suppose all the pending RIR''s and opened state labors will be sent to BRC and unopened labors from state will go to NPC.

Can anyone please shred some light on this??
