Hadron and others, I would appreciate your opinion.

I have always been on H1. I will be finishing my 5 year NIW on Oct 16, 2009. ( filed on Oct 2005 with 485 and hence a pd of 2005, october3 )

I also have a LC, 140, approved, second 485 filed, pd sept 16, 2004. 485 was filed in Aug 207 and I have come to know that it is "preadjudicated".

Now, I am working as a pediatrician, FT in a clinic with hospital on call duties. 40 hours/week. I have been offered a full time job in an urgent care facility as a pediatrician in a different city. ( will be 96 hours/week)

After finishing my NIW tenure( self filed) in oct, can i move on AC 21 to this new FT position? Is the job hours that important? I want to preserve my earlier pd. thru LC and hence this question.

Appreciate your opinion. Thanks

As I understand it, once you finish your NIW 5 year tenure and submit evidence to that effect, you are free to get your NIW 485 adjusted. One can stop working if so desired. I don't think you have to worry about future work situations impacting this NIW 485 adjustment.
