I found this forum and thank you all for being here.
OK, I had my interview for naturalization based on marriage to US citizen and passed both English and civics tests. The process was fast ( less than 10 min), during which the IO asked to verify my name, other info, took both tests, and finally signed the application. I thought I was done with it, but the IO told me that she couldn't make a decision because she didn't receive my "A" file that IS STILL PENDING... from TSC and I would hear from them within the next two weeks. Well, it's been almost 11 weeks since I had that interview( March 24, 2008) and I haven't heard a thing from USCIS.
Further, I made an info pass 8 weeks later without positive results. The USCIS agent told me that she would put a notice and call TSC to request my file. I was not the only one who had this problem because I found another similar case from another applicant.
According to N-652 form I received from IO, if USCIS don't make any decision within 120 days from the interview date, then I will have to file a case in the district court against the IO...!
I'm hoping I hear some good news before the end of July because I don't have no clue how the court stuff works...Yet I would like to get some help from you guys...! Anyone who has any idea about filing a case againt IO or USCIS after 120 days from the N-400 interview date? I really appreciate your help if you do.
FYI, I sent my I-751 in Nov 2006 and it's still pending because of the delays that occurred last july because of fees' increase. My FBI bg check was completed last February and my name check was cleared last February too. So I have everything okay except my "A" file is still in Texas Service Center, which I couldn't understand or believe....!!!!
