H4 with new H1 stamped

Hi,

I really appreciate you helping me out with this issue.

I have an old H1-B stamped on my passport (expiring Oct-2003). I got a new H1-B which I did not stamp (expiring Apr-2004).

Can I take the old visa copies along with the new visa copies to get H4 for my wife? Or do I need to stamp the new visa before H4 stamping? I cannot stamp it in US because it has more than 60 days of validity, so revalidation is not possible. I am not planning for a trip to India (or outside US) now because I came back a week ago after my marriage.

Please help me with this issue. Thanks in advance.

Yes. old visa and new visa approval (without visa stamp in passport) should fetch your spouse H4. Dont forget other docs - letter from employer, marriage certificate...
