H4 was not renewed will this be a problem during I485 processing ?

We are planning to wait till we hear back from USCIS regarding our 485 decision.

Since my wife has got new I94 and Advance Parole without a hitch she is in the status now.

Mean while we will speak to our attorney regarding nunc pro tunc for her H4 during the past black period.

we will not intiate the process of nunc pro tunc until we hear back on our 485 decision from USCIS

will that be resaonable conclusion ?

You are saying your wife has I-94 extended?

I just wanted to compare since my wife did get h4 extension of status

and I-94 with the dates that correspond with my third H1 visa transfer

Still there is a gap between her original I-94 date and I-94 start-end date

enclosed with her extension.

we both have three more h1/H4 extensions

I stumbled across your post yesterday and realized we may still be in trouble -


It would be gtreat if you can post what your attorney advise - so that I can

I am in a similar situation, I was out of status on H4 for 8 months(Back in dec 2002 to aug 2003) and after that I had a valid H1 and from then I am in status. Now my I485 is put on hold and RFE is asking about my 8 months of out of status.
Please advice what your attorney said about your wifes case.

Can we file for my H4 using the nunc pro tunc for my black days of 8 months of out of status?

Please advice, any help in this is highly appreciated.

Hi suman,
As this is a technical error, your I601 will approve if filed with strong EXTREAM hardship.

If you are in NJ, let me know, i can reffere to my lawyer who has more success in filing I601s. We recently got our I-601 approved.
