H4 Visa stamping for spouse when H1 expiring in 2 months

Hello folks,

Here is my situation..

My H1 visa is expiring on march 3 2003. I am planning to go to
india during december 02 for marriage. My company applies for
extension of H1 one month before expiry.

When I go to India in december would there be any problem
in getting H4 visa (in chennai consulate) for my future wife ?..
b'coz my H1 would expire in 2 months

Also are there any delays that I can expect in getting
H4 visa for the wife ?

really appreciate you inputs on this.

(Also I had applied for 485 at NSC. RD 7/02, FP 8/02).

See other posts where H4 was rejected for a similar case. However, even if H4 is rejected, you can come back to US, send the new approval back to India and get H4 again. It will also be advisable to apply for new H1 after you come back to US.

These days it is taking 4-5 months to get H1 extension at NSC.
Waiting till that time could be risky b'coz the 485 could be approved. After getting the wife here her 485 has to be applied.

This looks very problamatic. Would an H1 extension receipt
help in getting H4 for the wife in India. (the consulate
folks can take a look at the extension and stap h4. right!)

Do you have any other ideas.. to reduce the delay.

Try the H4 first with the current conditions, but be prepared to take contingent action.
Yes You can also try with the H1 receipt.
