H4 Visa Rejection

Hi ,

am a H1 visa holder.I got married last month in India adn applied for my husband's H4 visa.It was rejected on sec 214(b) basis.It was a very frustrating experience as I has to come back alone and that my husband can not apply for visa in person.

We had mentioned in the DS-156 form that we submit to the counsulate as the stay of my husband as 3 months and he had a discussion on the same with the counsular officer.Also few of friends are suspecting the reason for rejection could be my visa expiring after 2 months.

As we are planning to apply again through drop box.I was wondering if there are any other any documents I need to take from my company that could help my husband get his visa.

Are there any other options that I can try get my husband a H4 visa.

Sorry to hear this. Which consulate was this? Also H visas should not be refused under 214(b) which pertains to immigrant intent, isnt (as H has dual intent)?
 
It was the Chennai Counsulate.According to the letter of rejection..they wanted to make sure my husband returns to India....I wonder why they issue visas...and guarantee every one's return...

Was Curious abt any extra documents that can be sent from Us that would help in getting the Visa.....

A letter from employer will help. If the h4 applicant has the potential to apply for H1, consulate people have this sick reasoning of rejecting h4.
 
What shd be stated in the letter to be taken from the employer..can you pls be specific..

that so and so is employed at company... as ....getting this... salary. his/her spouse so&so is applying for H4. Please approve..
 
Thanks a lot for the advice!!.I have a valid H1 petition till Aug 2003 and a valid visa in my passport till Dec '02.

Is it adviceable to revalidate my visa till Aug'03 and send a copy of my passport to my husband ,for H4 application.

Also can I file for my husband's GC ,when he is in India...

It seems ridiculous to reject the H4 visa for u'r husband.

Also why did you go to Chennai counsulate, I thought u could have used the drop box facility for the first time itself.


Did they ask any other questions. What doc's did u take. Did they ask for any more docs?
 
H4 stamping when spouse's H1 is going to expire

My husband's H1 expires in Jan 2003. If i apply for H4 in Nov 2002 will i have any problem? His company has given him a letter stating they intend to extend his H1
