Hello Sir / Madam,
Here is the situation or the dilemma (whatever is applicable) for me as I am one completely confused guy
! I have not understood as to what is exactly required or can be done to get the H4 visa stamping of my family done in Mumbai. Another point I would like to make is that this won’t be their first stamping it is Re-Stamping that we are looking for. The reason for this confusion is:
1. I am in US and my Visa has expired, but I have a valid and appropriately approved I-94 by way of extension. Another twist to my case is that I also had my H1-B transferred to another company.
2. My Visa has expired as of August of 2006, and till 2 days back I had not known that I could have had the chance of re-validating my Visa while being in US. So the point is that I have an expired Visa but absolutely valid I-94 status.
3. My family was here in US with me till September’ 2007, their Visa also had expired but had a valid status as I had extended their I-94, which they had to surrender when they left US. (We do have a copy of that I-94 and extension approval)
Questions:
1. Can I get their stamping done in Mumbai, India even if I haven’t done it for myself?
2. What are the documents that would be required for getting their Visa stamped?
Reason:
I actually want to visit India and get our Visa’s stamped at the same time, as I think that would be an ideal situation. But, I just want to make sure that I plan for contingencies in case for some reason, I can not go to India due to work pressure or non-availability of leave.
Please do give me guidance as this will help me decide on my future course of action immediately. If re-stamping of my families visa is possible then please do provide me a complete list of documents that would be required for my family in India to go for re-stamping.
Note: I did visit the visa services site, but it does not seem to be clear on what documents are required for re-stamping or whether re-stamping for the family is possible even if the principal applicant’s visa has not been re-stamped, especially in cases such as mine.
