H4 Visa for spouse

Hello,

I am currently working in USA on H1B. I changed my employer last year and received new approval notice I-797 that expires in Feb 2006. The visa stamp in my passport is of the old employer and is valid until Jan 2005.

I'm planning to go to india in Nov India and get married. Will I need to get the new employer's H1 stamped in my passport in order to apply for H4 visa for my spouse?

No. Your spouse will only need your current original h1 approval notice, letter from your employer describing job duties and title, your most recent pay stubs, LCA copy, original marriage certificate. If you work for a body shop you will need more documentation.
