I recently had Job Change and my New Employer has filed for Transfer of my Visa.

According to the records my H1-B for my New Employer was filed for transfer on 5/17/2002 and the Receipt notice recieved on 06/10/2002
My wife's H4 was also filed along.

My wife wishes to travel to India in October. She will be back in November.
My wife is having a Valid Visa Stamped on her Passport (H4 from my previous Employer), valid through Nov 2003.

Q1. Would there be a problem for her Re-entry into United States?
Q2. What documents would she need to carry along during her travel?
Q3. If I recieve the New Visa approval from my New Employer while she is outside the country, can she re-enter USA with her old Visa stamping or does she have to have the new visa stamped?
Q4. What steps do I need to take if our New Visa(from new Employer) is approved while she is outside the country?
Q5. Does she need to carry a Copy of Receipt Notice from the New Employer ?

Your help is truly appreciated.
Thanks in advance.

Answers

1. No Problem
2. Copy of receipt notice is sufficient'
3. She does not need the new stamp. She can enter with showing the new approval and making sure that the new I94 has the new expiration dates (and right company name)

4.Send approval notice to her. If she enters with old company stamp and I94 and the approval was granted even a day before the I94 becomes invalid. This can be fixed by visiting POE again and getting a new I94.

5. Yes.
