H4 VISA for dependent with very close expiry date

Hello,
My wife is in india, but my VIsA is expiring on 07.01.04. My extension for H1 B has just begun (still praper work is being done) through premium processing and is anticipated to arrive at the end of the june. Is it advicible to bring my wfe on the old I-797 before July 1st 2004 or should i wait till my new VISa is approved to bring her here,

Remember, you need to extend H4 seperately. Extending your H1B won't extend a H4 automatically. If I were you, I'd wait to get the new H1B and get a H4 for the new H1B once for all in India.. (don't forget to call often while waiting... otherwise, you may not have anybody to bring on H4.. just kidding)
 
One problem is, she may have a hard time convincing the officer at the consulate to issue her a H-4 for 1 month. If you take away a week for getting all paperwork in shape and getting an appointment, we're looking at 3 weeks. Then, you'll need to file for her H-4 extension. If you absolutely must do this for some reason, talk to a good lawyer. It seems to be too much to do in too little time to me!

BTW, I was in a similar situation - H1B expiring and my wedding scheduled. I just waited to get my new H1B (premium processing) and then got a stamp for myself and my wife. The officer just did some small talk with me and asked my wife to not look so stressed out :o Very peaceful.

It should not be a problem in bringing on the old one. But if you are so near, why don't you wait for the premium processing to finish.

My spouse went for the interview with less then 2 mos. and prem. proc. pending. No problemo.
