H4 visa extension issue

Gurus,

I am on H1B visa and it is valid till Oct 2006. My kid(born in india) is on H4 and her visa is valid till Oct 2006 (same like me).

But her Passport expires on June 2006. And because of this her I-94 is valid till June 2006.

I am planning to apply for a new passport for my kid next month (at the San Francisco Indian Embassy). My questions are:

1) How can I extend the I-94 for my kid? Do we need to go out of US and come back for a new I94 or we can get it extended at the local INS office?

2) I applied for GC and so I am planning to extend my H1B after Oct 2006 (i.e, after 6 years). With a new passport for my daughter do I need to revalidate her H4 Visa? Or it is like a regular extension like me? When I should do that?

Please clarify.

Thanks in advance.

You can do both ways. You can go out and come back with new h4 visa stamped in your new pp, you will get your new I 94 valid upto Oct 2006. Or you can apply INS and get it. MAy take 6 to 12 months.

You have to have new pp for the baby. But no need to validate unless you wan t to go out of US and come back. Valid approval notice with I 94 at the bottom will sufficient to stay in US for ever (Validity date) without stamping the passport. Please clarify.

Thanks in advance.
