H4 Visa & Divorce

Hello,

My wife was here in the US on H4 visa. Subsequently she went back to India and we obtained divorce. If I get married again and wish to get my new wife here on H4, do I have to invalidate her visa through some form? My ex-wife's visa had already expired on the passport.

Please help.

As your ex-wife's visa is already expired- you don't have to do anything.

This is a very personal question. To keep things on surfact- I would say - the consulate in India can ask for your divorce papers from your second wife if they pull your previous petition for the first wife. The reasons would be-
to make sure your divorce is complete and your second marriage is valid;
to know more about you as a person so that the second wife is protected.
 
Once someone is in the U.S. on a temporary status (for example H visa), the status expires upon departing the country and gets re-instated at the point of entry. So I think, you are okay.
