I am posting this question on behalf of my friend. He's getting married and he has questions about h4 visa.
- Is his spouse eligible for applying the H4 Visa via Drop-Box in Chennai?
- Are there any gliches in using the Drop-Box facility for the Visa.
- Is it Mandatory now to attend the Chennai Consulate in person?

waiting time for passport return

Hi Sunil,
My wife and I are going for our visa appointment on April 1st. Do you know how long it takes for the consulate the return the visa?

I am not sure if a week's wait is going to be enough? our shipping address for the return of the passport is in Bangalore.

Most of my friends got the visa in less than 3 weeks from Chennai Consulate. It wouldn't be a problem, if you have all documents.

I would really appreciate if you can post the questions they ask.

My wife is planning to go for stamping in May.

Hi,
It will be mandatory for her to go in person the first time. She may be advised by the consulate to use the drop-box facility in case the consulate requires more documents. If ur visa is approved at the personal interview you should have your passport at your mailing address within a matter of days. But if they ask for more information and suggest that u use the drop box facility, then it may take a few weeks for u to receive ur passport. ( You have not mentioned what visa you are applying for, I'm assuming its a H1 /H4.)

It does help to have all the document in order, such as ur pay slips, w2's. Tax receipts for the last 3 years, marriage certificate, marriage photographs etc. It will be a problem though if at any point of time you have been in bench for extended periods of time. Any chennai H4 stamping experience for Australian nationals
I would like to know if there is an issue in getting H4 stamped in an Australian passport at Chennai consulate. I wonder if they tell the applicant to apply from Australia.

Initially my wife entered US on H4 visa, changed to H1 and worked for 2years. Currently working on EAD, i.e pending AOS would be approaching chennai consulate for H4 stamping in July/August 2004. H4 visa got expired in December 2002. Can she use drop box or an interview is mandatory. Depending on the experience I may have to alter this plan.

I do have a problem with one of my W2's (2002), which shows less salary than the LCA. Will this be an issue?

I have not filed my 2003 taxes yet. Since the 2002 shows less salary and 2003 has surplus is there any way I can handle this when I file my taxes for 2003.

The salary for 2002 is low, because my new employer started paying the 2002-salary only from Jan 2003. And I was on bench for like 3 months. So the w2 shows only half the salary than LCA.

Please advice.

Hi Rajudm:

Your wife will not be eligible for the drop-box facility because more than one year has passed since the last visa expired. Before planning to visit the Chennai Consulate, you need to determine her domicile before she went to the U.S. If it was South India, then you should not have a problem applying in Chennai. If the domicile was Australia, then it is advicable for her to visit the US consulate in Australia.

It is nice to know that your W2s for 2003 will reflect more than the amount mandated on the LCA. However, since the present employer has not paid you for 3 months in 2002, he has violated the LCA norms. This may create an issue with the Consulate. Did you work for the rest of 9 months and receive a salary in 2002?

If you have not been paid for 1 or 2 months, it should not be an issue. Need more details of your work/pay pattern in 2002 to advice.

Thanks for the response. Here is how it is; my 2002-W2 shows less than half the salary than what's specified in LCA.

Say for eg., LCA shows 40K and the W2's show 14K.

The reasons are;

1. 4 months I was in bench
2. 3 months salary was paid to me only in 2003

Hope this info is good enough.

What all question does they ask for H4 Visas?.Any idea?. My wife is attending the interview for the first time.

Do they ask for orginal W2 statments? or copies ok? TTS website doesn't mention orginal W2 or copies.

Late Returm Amandement

i guess u can revise u r old tax return by filling amandment form and show higher income raised by fillup a 1099 form. ofcourse u have to pay some more tax as u r filing it little late. (usualy 12% to 20% higher tax then normal)

check with u r Accountant and file and amandment for the year u have show less income. this will benifit u r employer also as u r showing 1099 he can throw it in expense if he want else its fine.

MAY BE u r account then print u a new revised taxreturn combined both. or just revised is fine.

Its kinda expensive way but if it helps then who cares. right? :)
